STANDARD TERMS AND CONDITIONS OF SALE
1. General
These Terms & Conditions apply to all sales of goods and services by Hydraulic Equipment Limited (“the Company”). By placing an order, the Customer confirms acceptance of these terms.
2. Quotations & Orders
All quotations are valid for 30 days unless stated otherwise. Orders are subject to availability and written acceptance by the Company. The Company reserves the right to refuse or cancel orders at its discretion.
3. Pricing
Prices are quoted in GBP and exclude VAT unless explicitly stated. The Company reserves the right to adjust pricing in the event of changes in material or manufacturing costs prior to order confirmation.
4. Payment Terms
Unless otherwise agreed in writing, payment is required in full prior to dispatch. Approved credit accounts must settle invoices within the agreed terms. Late payments may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998.
5. Delivery
Delivery times are provided in good faith but are not guaranteed. The Company shall not be liable for delays due to circumstances beyond its control. Risk transfers to the Customer upon collection or delivery to the agreed location.
6. Retention of Title
Ownership of goods remains with the Company until full payment has been received. Until that point, goods must be kept clearly identifiable and in good condition.
7. Returns & Cancellations
No returns will be accepted without prior written agreement. A restocking fee may apply. Special-order or customised products are non-refundable. Cancellations must be confirmed in writing and may incur charges depending on the order status.
8. Warranty
Unless otherwise stated, goods are warranted to be free from defects in materials and workmanship for a period of 12 months from the date of delivery. This warranty excludes wear and tear, misuse, or modification by the Customer. Liability is limited to repair or replacement of defective goods only.
9. Liability
The Company is not liable for indirect, incidental, or consequential loss or damage. Total liability under any contract shall not exceed the value of the goods supplied.
10. Force Majeure
The Company shall not be held responsible for failure or delay in fulfilling obligations due to events beyond its reasonable control, including but not limited to strikes, transport issues, import delays, or natural disasters.
11. Jurisdiction
These terms are governed by the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.
